RENTAL TERMS

General provisions.

The owner of the rental vehicle (RV) and the responsible Lessor is the Rental Company Etamp OÜ (Estonian
registration code 10475371, address Koluvere str 1, 78301 Märjamaa, Estonia).

These General Rental Terms and Conditions (“Terms”) are the basis of the Rental Agreement concluded between the customer (“Lessee”) and the rental company (“Lessor”).
The Terms must be communicated to Lessee before booking and completely understood by him.

With the Rental Agreement, the Lessor undertakes to hand over the reserved RV to Lessee on the date confirmed at the time of booking. Lessee undertakes to fulfill the obligations stipulated in the Terms. He/she also takes responsibility for the actions of the co-driver(s) specified in the Rental Agreement.

To confirm the booking an advance payment must be paid. By making an advance payment the Lessee agrees to the Rental Terms.

Until the advance payment is fully received, the Lessor is not obliged to book the RV to the Lessee. After receiving the advance payment, a booking confirmation will be sent to Lessee. Only then will the reservation become binding on both parties. If Lessee exceeds this deadline written in the offer the Lessor will cease to be bound by the reservation.

Subject of the Rental Agreement
The subject of the Rental Agreement is RV corresponding to the characteristic specified in the confirmed booking, the exact description of which is reflected in the general data of the record of the RV transfer and receipt (RV Transfer-Acceptance act).

Conclusion of the Rental Agreement
The Rental Agreement contains general rental conditions, rights and obligations of parties, legal remedies and liability of the parties, jurisdiction. The Rental Agreement is entered into with a person (individual or a representative of a legal entity) who has reached the age of 25 and has the right to drive a vehicle of category B with at least 5 years of driving experience. This rule applies to all additional drivers whose personal details are specified in the Agreement.

To take temporary possession of RV Lessee must provide his/her documents – a valid driver’s license and a passport or identity card. Without providing these documents the Lessee cannot obtain RV.

Additional drivers without providing their documents are not allowed to drive RV. For entering the personal data of an additional driver into the Agreement, a fee is charged in accordance with the current price list € 40.00 per rental period.

If the Agreement is concluded on behalf of a legal entity, Lessee presents a document certifying the right to represent legal entity.

Both parties sign the Agreement at the Lessor's location. In the Rental Agreement, the Lessor and Lessee agree on the rental period during which the Lessee has the right to use RV.

Payment conditions and rental price
The Lessee is obliged to make an advance payment for the booking within the period specified in a price offer. No later than 35 days before the handover of the RV, the Lessee must pay the Lessor the rental fee, service fee, the fee for additional equipment in the amount of 100%. If the rent is not paid in full by the appointed time, the Lessor has the right to cancel the booking. The rental fee is calculated according to the rate in effect on the day of booking the RV for the reserved period of the trip. The rental price consists of the basic rental fee per night and a service fee that applies to each rental. A service fee is charged once per rental. This flat rate includes the following costs for:

- handing over the vehicle;
- detailed instructions to the Lessee on how to handle the vehicle and its household appliances;
- refilling the propane gas (one cylinder 5,5 -11 kg);
- fresh water 90-120 L;
- windshield washer fluid;
- basic toilet chemicals 1L;
- external wash of RV upon return.

Use of RV during rental period
Lessee is obliged to use the RV carefully, in good faith and in accordance with operating instructions and generally accepted practices. 

Throughout the rental period, Lessee is required to monitor tire pressure and fluid levels. 

During the entire rental period Lessee is responsible for paying for fuel, AdBlue, windshield washer fluid and all running costs such as parking, camping, tolls, ferry costs, as well as fines and other penalties.

Lessee is prohibited from using RV for:

- commercial purposes (transport of passengers or goods)
- transportation of inflammable, harmful, dangerous substances or goods;
- towing of another vehicle or trailer;
- activities prohibited by law;
- participation in races, motorsport events, trainings and test drives.

Lessee is prohibited from:

- driving or entrusting the operation of RV to a person who is under the influence of alcohol, narcotic drugs or psychotropic substances;
- entrusting the operation of RV to a person not agreed upon by the parties;
- smoking in the RV;
- transporting pets or other animals in the RV without special permission of the Lessor;
- exceeding the RV’s load capacity specified in its technical passport (3500 kg);
- carrying more than the specified number of passengers;
- driving RV in bad weather conditions, such as: blizzard, sandstorm, limited visibility, when the wind speed exceeds 15 m/sec;
- driving with over- or under-pressured tires;
- filling RV with biodiesel or unlicensed fuel;
- using RV outside the territory of countries specified in the Agreement;
- leaving the documents and keys of RV unattended;
- carrying out external washing of RV;
- making any repairs to RV, including minor repairs (for example, removing scratches on the body and windows of the vehicle) without prior approval from the Lessor.

If Lessee breaks this condition and the RV is damaged, insurance coverage is not valid on the vehicle, and Lessee bears full responsibility for failure to comply with these rules.

NB: despite thorough disinfection of all motorhomes, the Lessor cannot guarantee the absence of allergens inside the motorhome. The Lessor is not liable for any deterioration in the Lessee's health due to an adverse reaction to an allergen found inside RV that caused said adverse reaction. It is important for Lessee with known allergies to exercise extra caution when renting RV. 

RV transfer procedure. Transfer-Acceptance act. 
RV is handed over to Lessee with a clean interior, completely fueled, filled with motor oil, AdBlue, with a full tank of fresh water, 1L of toilet chemicals, an electric cable, an extension cable, and must be returned to the Lessor in the condition specified in the Agreement. 
Bedding, kitchen utensils, dishes, gas grill, coffee machine, camping furniture are ordered separately and paid for additionally. All additional options must be ordered in advance, at least two weeks before the start of the rental. 
Before handing over RV, Lessee is obliged to listen to detailed instructions on its use and operation of its household appliances. Familiarization with RV and instructions are carried out by the Lessor’s representative directly in RV. Lessee signs the Transfer-Acceptance act, confirming that the operating instructions are completely clear to him/her.

Lessee, together with the Lessor's representative, is obliged to inspect RV before receiving it and after returning it to the Rental Station.

The condition of RV and its mileage upon receipt and return is recorded in the Transfer-Acceptance act, which must be signed by both parties.

When handing over and receiving RV, it is photographed. Image files are considered an integral part of the Transfer-Acceptance act and stored electronically.

RV must be returned thoroughly cleaned inside, with an empty waste water tank and empty toilet cassette. If these requirements are not met, the following cleaning costs will apply:

- Interior cleaning of Campervans: €120.00
- Interior cleaning of RV of other classes: €150.00
- Emptying waste water tank €30.00
- Emptying toilet cassette: €50.00

If Lessee does not intend or is unable to clean RV after rental, he/she may request any of the specified types of cleaning services in advance as an additional service.

RV must be returned with a full tank of fuel and a full tank of AdBlue (Lessee can confirm it by providing the receipt).

If the fuel tank is not 100% full, Lessee will be charged a filling-up fee of € 2.50/L for the missing fluids, as well as a service fee of €20.00.

If the AdBlue tank is not 100% full, Lessee will be charged a filling-up fee of € 1.50/L for the missing fluids, as well as a service fee of €20.00.

Any damage not specified in the Transfer-Acceptance act, detected upon return of RV, shall be subject to compensation at the expense of Lessee.

For the additional charge of €150,00, it is possible to pick up the RV in the rental station Märjamaa, and return it in the rental location Riga, or vice versa.

The times of pick-up and return of RV specified in the Rental Agreement are mandatory.

Pickup and return normally take place Monday through Saturday during the Lessor's normal business hours. On Sundays and public holidays, pickup and return of RV are only possible by prior arrangement, and for an additional fee.

Rental period
The minimum rental period set by the Lessor is 7 days, maximum - 90 days.

Shorter rental periods are possible with our “last minute” and flexible offers.

The rental period begins from the moment Lessee receives RV, its keys and documents at the rental point and ends at the moment the Lessor's employee accepts RV.

Acceptance of RV is considered complete when both parties sign the Transfer-Acceptance act.

When returning RV after the expiration of the rental period specified in the Agreement without the permission of the Lessor, Lessee shall pay €50,00 for each of the first two hours of delay. In case of delay for more than two hours Lessee shall pay in addition the amount of one rental day.

Any costs including loss of income to the Lessor, incurred as a result of the late return of the RV shall be borne by the Lessee.

If Lessee, for personal reasons and of his own free will, returns RV before the date agreed in the Agreement, rental fee, maintenance fee and fee for additional equipment will not be refunded to him/her.

Change of rental dates
Changing the rental dates is possible only by agreement with the Lessor.

Permitted areas for RV use. Mileage.
Mileage is unlimited for traveling in Estonia, Latvia, Lithuania, and Poland.
Mileage for Scandinavian countries – Finland, Sweden, and Norway - is limited 500 km per day, exceeding this limit is charged at the rate € 0.36 per km.
Use of RV outside the areas specified above, requires the Lessor’s permission.

Security Deposit.
On the day of handing over RV, Lessee is obliged to pay the Lessor a deposit agreed in the Rental Agreement (the “Deposit”) or provide the Lessor with a bank card issued in the name of Lessee and with a sufficient limit (a credit card or a suitable debit card, such as Visa, MasterCard to reserve the Deposit.

The Lessor has the right to cover possible damages, fines, loss of additional equipment, etc. at the expense of the Security Deposit.

Casco insurance (with a deductible of €1,400-1,500 per claim).

The Lessor refunds the deposit in full within five days of the return of RV, provided that RV is returned in the same condition as when it was issued, no damage or defects are detected.

Insurance
The comprehensive insurance includes: road assistance, unexpected incident outside of RV, traffic accident, natural disaster, fire, vandalism, damage caused by a third party, robbery and theft.

The theft insurance deductible is 10% of value of the RV specified in Rental Agreement. In case of theft of RV Lessee is obliged to provide RV keys and registration certificate.

Tires, rims of the vehicles, all interior details, household appliances, furniture, and keys are not insured, and the lessee bears full material responsibility for damage or loss of these items.

Cancellation of booking.
No later than 35 days before the transfer of RV, Lessee must pay the Lessor the rental fee , service fee, the fee for additional equipment in the amount of 100%. If the rent is not paid in full by the appointed time, the Lessor has the right to cancel the booking.

Lessee has the right to cancel the booking. If an advance payment has been made, but Lessee decides to cancel the booking before the date of payment of the full rental amount, the advance payment will be refunded minus an administration fee of €200.00.

If the Lessor is notified about the cancellation of the booking within a period of 34 to 20 days, Lessee will be refunded 50% of the total rental fee. If cancellation is notified less than 20 days before the start of rental period, rental fees, service fee and fees for ordered additional equipment are non-refundable, even if the cancellation is due to force majeure. Lessee can protect himself from the booking cancellation costs by taking out trip cancellation insurance.

Termination of the Rental Agreement.
The Lessor has the right to immediately terminate the Agreement if the Lessor becomes aware of circumstances that prevent the handover of the RV for Lessee’s use and/or the conclusion of the Agreement, such as:

- Lessee provides false information;
- Lessee has no right to drive RV;
- Lessee fails to make payments stipulated by the Agreement,
- Lessee doesn’t have sufficient funds to make the required payments.

The Lessor has the right to cancel Rental Agreement with immediate effect if it appears that Lessee made a material breach of the terms and conditions of Rental Agreement. In this case, Lessee is obliged to immediately return RV with all its accessories to the Lessor.

RV replacement 
The Lessor has the right to replace the booked RV with an equivalent or higher class vehicle with an agreed number of seats with safety belts and sleeping places.
